Agreement to Terms

By accessing or using Snowy Care at care.snowy.work ("the Service"), you agree to be bound by these Terms of Service ("Terms"). The Service is operated by ZYEYZ LLC dba Snowy Care ("we," "us," or "our"), a Montana limited liability company. If you do not agree to these Terms, do not use the Service.

Description of Service

Snowy Care is a cloud-based childcare management platform that provides tools for attendance tracking, enrollment management, compliance monitoring, parent communication, billing, and reporting. The Service is provided on a software-as-a-service (SaaS) subscription basis.

Accounts and Registration

To use the Service, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized access.

Subscription and Billing

  • Free Trial: New accounts receive a 14-day free trial with full access to all features. No credit card is required to start a trial.
  • Billing: After the trial period, you must select a paid subscription plan to continue using the Service. Subscriptions are billed monthly or annually in advance.
  • Payment Processing: All payments are processed securely through Stripe. By subscribing, you also agree to Stripe's terms of service.
  • Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial billing periods.
  • Price Changes: We may change subscription prices with 30 days' written notice. Price changes take effect at the start of your next billing period after the notice.

Your Data

You retain ownership of all data you enter into the Service ("Your Data"). We do not claim any intellectual property rights over Your Data.

  • License to Us: You grant us a limited license to use, process, and store Your Data solely to provide and improve the Service.
  • Data Export: You may export Your Data at any time in CSV or JSON format through the platform's export tools.
  • After Cancellation: When you cancel your subscription, Your Data remains accessible in read-only mode for 30 days. During this period, you can export all of Your Data. After 30 days, Your Data is permanently deleted.
  • Backups: We perform daily backups for disaster recovery. Backup copies of Your Data are deleted within 90 days of account termination.

Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
  • Attempt to gain unauthorized access to the Service, other accounts, or our systems
  • Interfere with or disrupt the integrity or performance of the Service
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Resell, sublicense, or redistribute the Service without our written consent
  • Use the Service to store or transmit malicious code

Intellectual Property

The Service, including all source code, software, designs, text, graphics, and documentation, is owned by ZYEYZ LLC dba Snowy Care and is protected by copyright, trademark, and other intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable right to use the Service. You do not acquire any ownership rights to the Service or its underlying source code.

Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, updates, or circumstances beyond our control. We will provide reasonable notice of planned maintenance when possible.

Limitation of Liability

To the maximum extent permitted by law, ZYEYZ LLC dba Snowy Care shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use of the Service. Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, secure, or available at all times.

Indemnification

You agree to indemnify, defend, and hold harmless ZYEYZ LLC dba Snowy Care and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Montana, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Montana.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or a notice on our platform at least 30 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
